E! News has reached out to representatives for Berry and Martinez regarding the filing, but has not received a response.
Berry filed almost a year after the couple finalized their divorce, nearly a decade after they separated in 2015. In the initial agreement, they agreed to share legal and physical custody of their son.
As per documents seen by E! News at the time, Berry was responsible for paying their 10-year-old’s private school tuition, uniforms, school supplies, and all activities including soccer.
The actress from John Wick was also ordered to pay $8,000 per month to Martinez, as well as 4.3 percent of any income exceeding $2,000,000.
Prior to finalizing their custody agreement, Berry had criticized the outdated child support laws.
In a 2021 Instagram post, she wrote, “I understand that some parents, whether male or female, may need assistance, but I believe that in today’s society, both parents are responsible for financially supporting their children and should work hard to do so.”
