Family of Órla Baxendale Suing Over Death Due to Allegedly Mislabeled Cookie
The company stated that it is collaborating with the Connecticut Department of Consumer Protection and the supplier to investigate the cause of the labeling error.
Meanwhile, Cookies United placed the responsibility on Stew Leonard’s. According to a statement released on Jan. 23 on their website, “Stew Leonard’s was informed by Cookies United in July of 2023 that this product now contains peanuts and all products sent to them have been properly labeled.” This product is sold under the Stew Leonard’s brand and repackaged at their facilities. The incorrect label was produced by and affixed to the product by Stew Leonard’s.”
However, in the lawsuit filed by Baxendale’s estate, Cookies United is also accused of negligence and being “strictly liable for the severe personal injuries and losses” suffered by the dancer. The lawsuit states that Cookies United had a responsibility to “inform and warn purchasers and consumers, as well as all previous purchasers and consumers, of any dangerous characteristics, potentialities, or defects discovered or discoverable after the initial packaging, marketing, distribution, and sale of the Florentine Cookie.”
E! News has reached out to representatives of Cookies Limited for comment but has not received a response. A representative of Stew Leonard’s informed E! News that they are unable to comment on ongoing legal proceedings.
